1. Acceptance of Terms
These Terms of Service (“Terms”) form a legal agreement between you and Plammix (“Plammix,” “we,” “us,” or “our”) governing your use of our messaging applications, websites, software, communications features, communities, support channels, and related services (collectively, the “Service”).
By creating a Plammix account, downloading or using the application, or accessing the website or other parts of the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use Plammix.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. The Service
Plammix is a digital communications service designed to help people communicate and interact through features that may include private messages, group conversations, communities, media sharing, profiles, voice or video features, notifications, and other tools.
We may introduce new features, modify existing features, or discontinue features over time. Some features may not be available in every country, language, operating system, or version of the application.
You are responsible for obtaining and maintaining the devices, software, and internet connection required to use the Service. Your mobile carrier or internet provider may charge you for data or other network usage.
3. Eligibility and Minimum Age
You may use Plammix only if you can legally enter into an agreement with us and are permitted to use the Service under applicable law. You must meet the minimum age required to use online services in your jurisdiction.
If you are under the age of majority where you live, you represent that you have obtained any consent required from a parent or legal guardian before using the Service.
You may not use Plammix if applicable law prohibits you from receiving our Service or if you have previously been suspended or removed for a serious or repeated violation of these Terms.
4. Your Account and Security
Certain parts of Plammix require an account. You agree to provide accurate information where requested and to keep account information reasonably up to date.
You are responsible for maintaining the security of your account, devices, authentication methods, and credentials. If you believe your account has been accessed without authorization, contact us promptly and take reasonable steps to secure your account.
To the extent permitted by law, you are responsible for activity that occurs through your account unless that activity results directly from a security failure caused by Plammix.
5. Acceptable Use
You must use Plammix lawfully and responsibly. You may not use the Service, or help another person use the Service, to violate applicable law; harass, threaten, stalk, intimidate, exploit, or unlawfully discriminate against another person; publish unlawful or seriously deceptive material; impersonate another person or organization in a misleading way; distribute malware or other harmful code; attempt unauthorized access; interfere with or disrupt the Service; scrape or collect information without authorization; send spam or unsolicited bulk communications; infringe intellectual-property or privacy rights; facilitate fraud or unlawful financial activity; or circumvent security measures or enforcement actions.
We may take action when we reasonably believe that conduct violates these Terms, creates risk for users or the Service, or is otherwise unlawful.
6. Your Content
You may provide, upload, send, publish, or otherwise make available content through Plammix (“User Content”). You retain ownership of the intellectual-property rights you hold in your User Content.
You grant Plammix a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, and otherwise use your User Content solely as necessary to operate, maintain, improve, and provide the Service and to comply with applicable law.
You represent that you have the rights and permissions necessary to provide your User Content and that your User Content and use of it through Plammix do not violate these Terms or applicable law.
7. Moderation and Enforcement
Plammix may use a combination of user reports, automated tools, and human review to enforce our rules and protect the Service. The availability and level of moderation may vary depending on the feature and the nature of the content.
Where appropriate, we may remove content, restrict visibility, limit account functionality, issue warnings, temporarily suspend access, or permanently terminate an account.
We may not act on every report, and we do not guarantee that all objectionable or unlawful content will be identified immediately. Content appearing on the Service is not necessarily endorsed by Plammix.
8. Our Rights and Intellectual Property
The Service, including Plammix software, branding, logos, design, interfaces, text, graphics, and other materials provided by us, is protected by applicable intellectual-property laws.
Subject to these Terms, Plammix grants you a limited, personal, non-exclusive, non-transferable, and revocable license to use the Service for its intended purpose.
You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, create derivative works from, or otherwise exploit the Service or our materials except where applicable law expressly permits such activity.
9. Paid Services and Payments
Some features or products may be offered for a fee. Before completing a purchase, we will provide information required by applicable law regarding the relevant price and payment process.
Payments may be processed directly by Plammix or through third-party payment providers. You agree to provide accurate and authorized payment information and to comply with the terms applicable to the chosen payment method.
Refunds, cancellations, subscriptions, and payment disputes are governed by our Payment & Refund Policy and any mandatory rights provided by applicable law.
10. Third-Party Services
The Service may interact with third-party websites, platforms, stores, payment processors, or other services. These third parties operate under their own terms and privacy policies.
Plammix is not responsible for third-party content, services, availability, or practices unless applicable law requires otherwise. Your use of third-party services is subject to the terms that apply to those services.
11. Privacy
Your use of Plammix is also governed by our Privacy Policy, which explains how information is collected, used, stored, and otherwise processed in connection with the Service.
Depending on the feature you use, Plammix may process technical information, account information, communications-related information, and other data necessary to operate and secure the Service.
12. Service Availability
We work to keep Plammix available and reliable, but we do not guarantee that the Service will always be uninterrupted, error-free, secure, or available in every location.
We may perform maintenance, updates, emergency work, or changes that temporarily affect access to some or all of the Service. We are not responsible for failures caused by circumstances outside our reasonable control, including network outages, failures of third-party infrastructure, natural events, or government actions.
13. Suspension and Termination
You may stop using Plammix at any time. You may also request deletion of your account, subject to our Privacy Policy and any legal obligations that require us to retain certain information for a limited period.
We may suspend or terminate access if we reasonably believe that you have materially or repeatedly violated these Terms, created a security risk, exposed Plammix or other users to legal liability, or engaged in unlawful conduct.
Where appropriate, we may attempt to provide notice before suspension or termination. We may take immediate action when delay could create a risk to users, the Service, or others.
14. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis. Plammix does not guarantee that the Service will meet every user's requirements or be available at every time and location.
We do not guarantee the accuracy, legality, reliability, or quality of content provided by users or third parties. Nothing in these Terms excludes rights or protections that cannot legally be excluded under applicable law.
15. Limitation of Liability
To the maximum extent permitted by law, Plammix and its affiliates, officers, employees, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from or relating to your use of the Service.
Where applicable law permits a limitation of liability, Plammix's total liability for claims arising from or related to the Service will be limited to the greater of the amount you paid to Plammix for the relevant paid Service during the twelve months before the event giving rise to the claim, or the minimum amount required by applicable law. Some jurisdictions do not permit certain limitations or exclusions; in those jurisdictions, our liability will be limited to the fullest extent permitted by law.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Service, applicable law, security practices, or our operations.
When we make changes, we will update the “Last updated” date at the top of this page. For material changes, we may provide additional notice through the Service or by other appropriate means.
Your continued use of Plammix after updated Terms become effective means that you accept the updated Terms, to the extent permitted by law.
17. Governing Law and Disputes
These Terms and any dispute arising from or relating to them are governed by the laws applicable to the Plammix entity that provides the Service to you, except where mandatory consumer-protection law requires otherwise.
Mandatory laws of your country of residence may provide additional rights that cannot be waived by these Terms. We do not intend for these Terms to limit any rights that cannot legally be limited.
